(6) Safety of your data
This website uses the TLS cryptographic protocol, which protects you against phishing and unauthorised access to communications by third parties, e.g. when using public WLAN. Watch for the lock symbol in your browser, and make sure that the URL is correct, without any typos. If you visit this website on a regular basis, we recommend opening it by means of a bookmark instead of any links you may have received by email. Please note that data transfer via the internet may entail security risks. Complete protection of the data against access by third parties is not possible. However, the measures described above make such access significantly more difficult.
§ 2 Collection of personal data while using our website
(1) If you use our website for information only, i.e. if you do not register or otherwise provide information to us, we only collect the personal data that your browser transmits to our server. If you want to view our website, we collect the following data, which are technically necessary for us to be able to display our website and ensure stability and safety (legal grounds pursuant to Art. 6 (1) lit. f GDPR):
- IP address
- date and time of the request
- time zone difference to Greenwich Mean Time (GMT)
- content of the request (specific website)
- access status/HTTP status code
- data volume transmitted
- website sending the request

- operating system and interface
- browser software language and version.
These data will be stored for a period of 7 days. After this period of time, that data are anonymised and used for statistical purposes only.
(2) Use of cookies
We use cookies. Cookies are small text files that are stored on your device and can later be called up by the website. They enable certain features of the website that require the storage of data, including settings, shopping baskets, login data, and similar functions.
You can adjust the settings of your browser in such a way that you are notified of the placement of cookies, accept cookies only in individual cases, decline acceptance of certain kinds or any kind of cookies, and activate automatic deletion of the cookies when you close your browser. (3) Contact by email or the contact form
If you contact us by email or a contact form, the information provided by you (your email address, your name, if applicable, your phone number and the request you sent) are saved by us for the purpose of answering your questions. The data collected in this context will be deleted when further storage is no longer required,
i.e. when your concern has been answered, or the processing will be restricted in the case of statutory retention obligations. In principle, requests that have been answered are deleted after 28 days.
Other features and offers of our website
§ 3 Newsletter
(1) By giving your consent, you can subscribe to our newsletter, which informs you about our current offers and news. The advertised goods and services are specified in the declaration of consent.
(2) We use the so-called double opt-in approach for subscription to our newsletter. This means that when you subscribe, we send an email to the email address provided by you, requesting your confirmation that you really want to receive our newsletters. If you do not confirm your subscription within 24 hours, your data will be blocked and automatically deleted after one month. Furthermore, we store the IP addresses you used and the date and time of the subscription and confirmation. The purpose of this approach is to verify your subscription and clear up any improper use of your personal data, if necessary.
(3) To receive our newsletter, you only have to provide your email address. Any other, separately selected data are provided on a voluntary basis and used to address you personally. Upon your confirmation, we will save your email address for the purpose of sending you the newsletter pursuant to Art. 6 (1) lit. a GDPR.
(4) You can withdraw your consent to receive the newsletter and unsubscribe from the newsletter at any time. You can withdraw your consent by clicking on the link contained in each newsletter, by email to newsletter[at]schloss-wackerbarth[dot]de, or by sending a message to the contact details indicated in the legal notice.
(5) Please note that we will analyse your user behaviour when we send you our newsletter. For this purpose, we use the newsletter service provider CleverReach. For the analysis, the emails we send contain so-called web beacons or tracker pixels, i.e. single-pixel image files that are stored on our website. The data specified in § 3 and the web beacons are linked to your email address and an individual ID for the analysis. Links indicated in the newsletter contain the same ID.
(6) The data are collected in anonymised form only, i.e. the IDs are not linked to your other personal data. Direct reference to persons is excluded.
(7) You can object to this tracking at any time by clicking on the separate link contained in each email, or by notifying us by another method of contact. The information will be stored for as long as you subscribe to the newsletter. After you unsubscribe, we will store the data in anonymised form and for statistical purposes only.
(8) Tracking is furthermore impossible if the display of images is deactivated by default in your email programme. In this case, the newsletter will not be fully displayed and you may not be able to use all its features. If you manually activate the display of images, tracking as described above is enabled.
§ 4 Online shop
(1) If you want to place an order in our online shop, you are required to provide your personal data necessary for the processing of your order upon conclusion of the contract. Mandatory information required for the execution of the contracts are marked accordingly; all other information is optional. We process the data provided by you for the purpose of processing your order. For this purpose, we may transmit your payment information to our principal bank, and your addresses to our carrier for dispatch pursuant to Art. 6 (1) lit. b GDPR.
(2) You can optionally create a customer account that allows us to save your data for subsequent orders. If you create an account under “My account”, the data you provide are saved until revoked. You can delete all other data, including your user account, in the customer section at any time.
(3) We may furthermore process the data provided by you in order to inform you of other interesting products from our portfolio or send you emails with technical information. You can object to such processing at any time.
(4) Because of statutory provisions under commercial and tax law, we are obligated to save your address, payment and order information for a period of ten years. However, we limit the processing of such data after two years, i.e. your data will only be used for compliance with the statutory obligations.

In their services, (e.g. Google Analytics, Maps), Google always processes data for their own purposes, which Schloss Wackerbarth has no influence over. In the following, we will provide as much information as possible about the purposes and legal grounds of the use of these services and the data processed in this context. Whenever possible, we only use these services with your consent in order to provide additional features to you when using the website (e.g. Google Maps), or to better understand the way our customers use our website (Google Analytics).
You can give or refuse your consent in the cookie banner. Your consent can be withdrawn at any time as described in the section “Withdrawal”.
§ 5 Matomo
We use the open source application Matomo to prepare general, anonymised usage statistics of our website. We operate it locally. Due to the local usage, your data is not transferred to any third party.
The following data are collected by means of Matomo:
- shortened IP address
- date and time of access
- length of stay
- type of device
- error codes occurred
- browser details (browser type and version, operating system, language, time zone)
- referrer URL (the last website you visited, if the browser reports it)
- the pages you visited on our website
- data volume transmitted to you
The IP address is only stored in anonymised form by deleting the last two of the four octets (e.g. 123.45.xxx.xxx). We do not create a user profile for you as a person or your browser, we only aggregate data into anonymised statistics.
The legal basis for the processing is our legitimate interest in improving our website pursuant to Art. 6 (1) lit. f GDPR; within the framework of a balancing of interests, we only use aggregated information that cannot be traced back to individual persons for this purpose, for which we do not require your consent.
§ 6 Use of Friendly Captcha as spam protection
The Friendly Captcha tool is integrated into the contact form on our website as anti-bot verification. It verifies whether entries into the contact form are made by a human user or by machines or automated programmes (so-called bots). For this purpose, the provider of Friendly Captcha, Friendly Captcha GmbH (Am Anger 3‐5, 82237 Wörthsee, Germany) collects the following data:
- anonymised IP address of the computer sending the request,
- information about the browser and the operating system used,
- an anonymised counter per IP address to control the cryptographic tasks, and
- the referrer URL, if applicable
The tool does not place or use any cookies. Friendly Captcha only receives the data when you click on the button to start the anti-bot verification. The provider gives details about the processing here: https://friendlycaptcha.com/de/legal/privacy-end-users/.
If we receive data in this context, we will process them only for as long as necessary to verify your entries, and then we delete them. We use Friendly Captcha only to discover and prevent uses of our website that are improper or designed to cause technical damage. The legal basis for the processing is our legitimate interest within the meaning of Art. 6 (1) lit. f GDPR, which supersedes the rights and freedoms of the data subjects.
§ 7 Use of Google Maps
(1) We use Google Maps on some of our web pages in order to give you information about our location and possible access routes. It is integrated only if you have accepted “Third-party content” in the cookie banner. The legal basis for the processing is your consent pursuant to Art. 6 (1) lit. a GDPR.
(2) When you visit our website, Google receives the information that you called up the respective page at that specific time and using your current IP address from Maps. This happens irrespective of whether you are logged in to a Google user account at the time, or whether there is no user account. If you are logged in to Google while you are visiting our website in your browser, your data is directly allocated to your account. If you do not wish for your data to be allocated to your Google profile, you need to log off from Google before visiting our website. Google stores your data as a user profile and uses them for purposes of advertising, market research and/or the needs-based design of their website. The data is analysed in particular (and even for users that are not logged in) for the purpose of providing needs-based advertisements, and to inform other users of the social network about your activities on our website. You have the right to object to the creation of such user profiles, but in order to exercise this right, you have to contact Google.
(3) Information that is transmitted to Google due to the integration of Maps:

- date and time of your visit to our website
- browser details (operating system, version, time zone, language, installed fonts and add-ons, ...)
- the web page currently visited
- If you are currently logged in to your Google account, the data are linked to your account.
(4) If you did not accept processing for “Third-party contents” in the cookie banner, no data will be transmitted.

§ 8 Facebook / Instagram
(1) We have business pages on Facebook and Instagram. These social media platforms are operated by Meta Platforms, Inc., 1 Hacker Way, Menlo Park, CA 94205, USA. (2) Joint controllers for Facebook
On Facebook, some of the data are processed by joint controllers. Facebook and the operator of this website are joint controllers for contents that you[US1] place on the platform yourself, i.e. comments, private messages and the like, pursuant to Art. 26 GDPR. You can find the corresponding data processing agreement at https://www.facebook.com/legal/terms/page_controller_addendum.
Since only Facebook has information about the data actually collected and their use, requests for information and claims relating to other rights of data subjects should be addressed directly to Facebook. You can, of course, address such requests to us as well, and we will forward them to Facebook for processing in accordance with the above-mentioned agreement.
(3) Type and purpose of data processing
We only receive an anonymised analysis of demographic characteristics of the profile visitors and their interaction with our Facebook page within the framework of the Insights data. These data are only used to analyse the general user behaviour and the target group. They are not transmitted to third parties. The data is processed in accordance with Art. 6 (1) lit. f GDPR. Our legitimate interest is the presentation of our business and the communication with our customers or prospective customers. Visiting our Facebook profile is entirely voluntary.
Facebook processes your data for their own, commercial purposes. For this purpose, Facebook also uses cookies. We do not know which data are collected and for which purposes such data are used by Facebook. In this respect, please refer to Facebook’s privacy policy available at: https://www.facebook.com/policy
(4) Categories of personal data processed
Facebook provides the following data to us as operator of the page for analysis. Please note that the data are anonymised and aggregated into groups:
- age and gender
- relationship status
- level of education
- occupation
- top categories
- “Likes”
- top cities
- top countries
- top languages
- frequency of activities
- device user
(5) Facebook collects and processes other data to a significant extent, including particularly sensitive personal data pursuant to Art. 9 GDPR. However, we can neither examine these data nor influence the collection of such data. Facebook is solely responsible for the collection and processing of such data pursuant to their own privacy policy, which is available at https://de-de.facebook.com/about/privacy.
(6) Place of processing
The anonymised data used by us are processed only within the territory of the EU or the EEA. We do not transfer data to third countries.
Facebook processes the data, at least to some extent, in the U.S., a third country outside of the EEA, where the GDPR is not directly applicable and the level of protection is insufficient according to the decision of the EU Commission.

§ 9 Rights of access and complaint
(1) You have the following rights vis-à-vis us regarding your personal data:

§ 10 Objection to processing of your data or withdrawal of consent
(1) If you have consented to the processing of your data, you can withdraw such consent at any time. Such withdrawal affects the admissibility of the processing of your personal data from the time you declared the withdrawal.
(2) To the extent that the processing of your personal data is based on a balancing of interests on our part, you can object to such processing.
